HabitGate Terms of Use

These Terms of Use ("Terms") govern your access to and use of the HabitGate website (HabitGate.app), the HabitGate mobile applications, the HabitGate Chrome extension, and related services (collectively, the "Service"). The Service is operated by HabitGate, Inc. ("HabitGate," "we," "us," or "our").

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Privacy

Our collection and use of information is described in our Privacy Policy. By using the Service, you agree that we can process information as described there.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18 (or the age of majority where you live), you represent that you have your parent's or legal guardian's permission to use the Service.

3. The Service

HabitGate helps you reduce distractions by blocking selected websites and apps and presenting habits or tasks you choose to complete before continuing.

You are responsible for:

  • Choosing which websites/apps to block and which habits/tasks to configure;
  • Installing and maintaining any required permissions (including OS/browser permissions);
  • Your device settings, Screen Time settings, and any passcodes you set (and whether you share them).

We do not guarantee that the Service will block every distraction in every circumstance, or that you will achieve any particular outcome.

4. Accounts

Some features require an account. You agree to:

  • Provide accurate information;
  • Keep your credentials secure;
  • Notify us promptly if you believe your account has been compromised.

We may suspend or terminate accounts for violations of these Terms or to protect the Service.

5. Subscriptions, Billing, and Payments

Some features may require a paid subscription ("Paid Plan"). You may be able to purchase a Paid Plan through:

  • Apple App Store (iOS),
  • Google Play (Android), and/or
  • Our website checkout (processed by Stripe or another payment processor we select).

5.1 Auto-renewal

If you purchase a subscription, it may automatically renew until you cancel. How you cancel depends on where you purchased:

  • App Store / Google Play: Manage and cancel in your Apple/Google account settings. The store's terms and billing rules apply.
  • Website (Stripe): Cancel using the cancellation method we provide (for example, an account portal) or by contacting support.

5.2 Pricing and taxes

Prices may change from time to time as permitted by applicable law. Taxes may apply depending on your location and the purchase method.

5.3 Refunds

Refunds depend on where you purchased:

  • App Store / Google Play: Refund requests are handled by Apple/Google under their policies.
  • Website purchases: We handle refunds according to our posted Refund Policy (if any) and applicable law.

6. Your Content and Sync

"User Content" means information you input into the Service, such as habit titles, schedules, and completion status.

You retain ownership of your User Content. You grant us a limited license to host, store, process, and transmit your User Content only as needed to operate the Service, including syncing across devices for Paid Plan users.

7. Acceptable Use

You agree not to:

  • Use the Service in violation of law;
  • Attempt to bypass, disable, or interfere with security-related features of the Service (except as needed to uninstall/stop using the Service on your own devices);
  • Reverse engineer, decompile, or attempt to derive source code from the Service (to the extent such restrictions are permitted by law);
  • Access the Service in a way that could damage, disable, overburden, or impair it;
  • Use the Service to develop a competing product based on non-public aspects of the Service.

8. Intellectual Property

The Service (including software, design, and trademarks) is owned by HabitGate or its licensors and is protected by intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use (unless we expressly agree otherwise in writing).

9. Third-Party Services and Links

The Service may interact with third-party services (for example, the App Store, Google Play, Stripe, analytics providers, or websites/apps you choose to block). We do not control third-party services and are not responsible for their content, policies, or availability. Your use of third-party services is governed by their terms.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, HABIGATE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that blocking/interruption features will work in every situation.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HABIGATE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HABIGATE'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF:

  • THE AMOUNTS YOU PAID TO HABIGATE FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR
  • $100 USD.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless HabitGate and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service or your violation of these Terms.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service if:

  • You violate these Terms,
  • We reasonably believe it is necessary to protect the Service, other users, or the public, or
  • We are required to do so by law.

Sections that by their nature should survive termination (including Sections 8-13) will survive.

14. Changes to the Service or Terms

We may modify the Service and these Terms from time to time. If we make material changes, we will take reasonable steps to notify you (for example, by posting on the website or in the app). Your continued use of the Service after changes become effective means you accept the updated Terms.

15. Governing Law and Venue

These Terms are governed by the laws of the State of Washington, excluding its conflict of laws principles.

You agree that any dispute arising out of or relating to these Terms or the Service will be brought in the state or federal courts located in King County, Washington, and you consent to personal jurisdiction in those courts.
